What it does
SB 1566 - This act requires prosecuting attorneys to make certain disclosures about the use of informants in a criminal case. Under the provisions of this act, a prosecuting attorney must disclose the identity of the informant and the substance of the testimony.\r \r \tThis act requires that all phone and in person communication by law enforcement or prosecution personnel with informants be audio or video recorded and shared with the defense. In addition, all written communication with the informant must be shared.\r \r \tUnder this act, the court shall conduct a pretrial hearing to determine the reliability and admissibility of the informant's testimony upon the motion of the defendant.…
