1.04.020 - Conflict of provisions.#
Where it appears that a provision of this code regulates in an area governed by the United States Constitution, the Constitution of the State of Utah or competing federal or state law or regulation, the provision should be construed as narrowly as possible to avoid a conflict with those superior bodies of law. If portions of a particular provision of this code may be severed from the whole without completely eviscerating the purpose of the provision, a reviewing court of law may sever the offensive portion. If there are conflicting provisions of law within this code, the provision that is most particular to the subject matter at issue shall govern over a less specific provision.
