(a)
Drilling; maintenance; when allowed.
(1)
No person, corporation, and the like, other than the town, shall be allowed to drill and/or maintain a well for any purpose; nor shall any person, corporation, and the like allow the drilling of any well on any property within the town limits, unless water lines owned and maintained by the town shall not be located or cannot be brought by the town to a point within 250 feet of the property line. Final determination of the ability of the town to extend water lines shall be made by the town council.
(2)
Any well allowed, as described in subsection (a)(1) of this section, shall continue only until water lines owned and maintained by the town are extended to a point within 250 feet of the property line, at which time section 34-22 shall apply.
(b)
For use in conjunction with water source heat pumps. The town council may authorize private water wells for use in conjunction with water source heat pumps only if available water from the town's water system is not temperately suited for use in such a heat pump. Applicants who are granted permission to install private wells for use in a water source heat pump shall not use the well for producing water for any other domestic or sanitary application. Applicants shall also eliminate water source heat pump discharges in such a manner so as to prevent health hazards or public nuisances. Discharges shall not be allowed in the town's sanitary sewer system.
(c)
Written request for permission to install required; violation. Requests for permission to install private wells must be in writing and considered by the town council at a regularly scheduled meeting. The council may, at its discretion, consult the county health department and/or the state department of health and environmental control for advisory opinions prior to granting applicants permission to install private wells. Penalties for the installation of a private well without authorization shall be as set forth in section 1-14. Each day shall constitute a separate offense.
