Sec. 21-36. - Purpose.#
The purpose of this division is to set forth the principles for the imposition of sewer connection fees and to set forth the formulas and rates for the computation of the connection fees. (a)
This division applies when three (3) conditions have been met. First, a new physical connection to the system is made either directly at the main or indirectly on the property. Secondly, there is an impact on the system as a result of the increased sewer flow for the property. Third, there is an increase in the number of connections or users on the property.
(b)
This division shall not apply to a change in use within an existing structure unless all three (3) conditions referred to above have been met.
(Ord. of 3-9-2010, Art. III, § 1)
Sec. 21-37. - Definitions.#
As used in this division, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended.
Equivalent dwelling unit (EDU) shall mean the unit utilized in this division to equate sewer uses, being the imputed average daily flow of sewage from the average single-family residence within the town, to produce the number of service units to be attributed. For the purpose of this division one EDU shall be two hundred and fifty (250) gallons per day.
Sewer connection fee shall mean the fee required from a new connector to the sewer system, representing a fair payment toward the total capital cost paid for developing the system.
Sewer service unit shall mean the estimated average daily flow of sewage for the new connector divided by two hundred and fifty (250) gallons, which represents the equivalent dwelling unit.
(Ord. of 3-9-2010, Art. III, § 2)
Sec. 21-38. - Alterations—Permit required.#
Connections, alterations or repairs to any public sewer or other appurtenances of the sewer system in the town shall not be made by any person without a permit issued by the town. No unauthorized person shall open the cover of, enter or alter any manhole or other appurtenance of any public sewer; place or insert in any public sewer or its appurtenances any foreign material which the sewer or its appurtenances was not intended to receive, nor shall any person damage, destroy, uncover, deface or tamper in any way with any public sewer or its appurtenances.
(Ord. of 3-9-2010, Art. III, § 3)
Sec. 21-39. - Permit applications.#
Application for permits shall be made on forms supplied by the town and shall state the location and character of the work to be performed; the person granted permission to perform such work; the time limit for construction of the work; the general character of the wastes which are or may be discharged into the sewer in question; and any other pertinent information or conditions. The permit application shall be supplemented by any plans and specifications considered pertinent in the opinion of the sewer engineer. (See also section 21-164)
(Ord. of 3-9-2010, Art. III, § 4)
Sec. 21-40. - Fees.#
A permit and inspection fee of one hundred fifty dollars ($150.00) shall be paid at the time the application for the permit is filed. If multiple inspections are required, the third and subsequent inspection shall require payment of a fifty dollars ($50.00) fee each prior to the inspection. Failure to call for and pay for such inspections shall be punishable by a fine as set forth in section 21-102 hereof. These fees are in addition to the connection charges established in this division.
(Ord. of 3-9-201, Art. III, § 5)
Sec. 21-41. - Escrow deposit.#
All permit applications, except for single-family residential dwellings, shall be accompanied by an escrow deposit of five hundred dollars ($500.00) to cover costs of engineering review of plans and specifications. If this sum is inadequate to cover the costs of plan review, applicant shall supplement the same. Unexpended escrow funds shall be returned to the permittee at conclusion of the work.
(Ord. of 3-9-201, Art. III, § 6)
Sec. 21-42. - Suspension/revocation of permits.#
Any permit may be suspended or revoked by the sewer engineer on written notice to the permittee for violation of the conditions thereof or for any violation of the requirements of these regulations or for other reasons in the public interest.
(Ord. of 3-9-2010, Art. III, § 7)
Sec. 21-43. - Connection fee.#
A connection fee shall be imposed for each sewer connection based on the sewer connection rate set forth herein and the total number of equivalent dwelling units attributed to a connector set forth in the schedule or attributed to a connector if the schedule does not apply.
(Ord. of 3-9-2010, Art. III, § 8)
Sec. 21-44. - Fee due prior to permits.#
The connection fee imposed shall be payable to the town at the town hall prior to the issuance of a construction permit and shall be deemed prior approval.
(Ord. of 3-9-2010, Art. III, § 9)
Sec. 21-45. - Computation of fee.#
When a business, structure or use is described in the schedule of equivalent units (section 21-51 hereof), the connection fee shall be computed by applying the number of gallons per day projected for the use to the number of gallons per day (two hundred and fifty (250)) for an EDU, and multiplying the number of EDUs by the sewer connection rate set forth herein.
(Ord. of 3-9-2010, Art. III, § 10)
Sec. 21-46. - Alternate computation of fee.#
When a business, structure or use is not described in the schedule of equivalent units, the connection fee shall be computed by multiplying the number of service units attributed to each connector by the town by the sewer connection rate set forth herein.
(Ord. of 3-9-2010, Art. III, § 11)
Sec. 21-47. - Certification of average daily flow.#
In the event a business, structure or use is not described in the schedule of equivalent uses, the owner or developer shall provide to the town sewer engineer a certification from an engineer for the average daily projected sewer flow for each business, structure or use. The sewer connection fee shall be calculated based on the certification provided in accordance with the above formula, subject to the approval of the town sewer engineer. If the town sewer engineer does not approve of the quantity proposed, the town sewer engineer's determination as to the quantity shall determine the average daily projected sewer flow.
(Ord. of 3-9-2010, Art. III, § 12)
Sec. 21-48. - Multiple fees.#
Where a building or a structure is to be occupied by more than one (1) residential, commercial or industrial use, or establishment, or any combination thereof, the connection fee imposed shall be determined by applying the aforesaid schedule or formula for each residential, commercial or industrial or other use or establishment located thereon.
(Ord. of 3-9-2010, Art. III, § 13)
Sec. 21-49. - Sewer connection rate.#
The sewer connection rate for each equivalent dwelling unit (EDU) or sewer service unit is hereby established at seven hundred fifty dollars ($750.00).
(Ord. of 3-9-2010, Art. III, § 14)
Sec. 21-50. - Per unit rates.#
Each dwelling unit shall be determined to be one (1) EDU. For example, a two-family residence shall; be deemed to be two (2) EDUs and a ten-unit condominium shall be deemed to be ten (10) EDUs.
(Ord. of 3-9-2010, Art. III, § 15)
