DIVISION 1. - GENERALLY#

Secs. 74-171—74-185. - Reserved.#

DIVISION 2. - WATER AND SEWER SYSTEMS EXTENSION#

Sec. 74-186. - Financing.#

(a)

An individual property owner, with town council approval, may extend a water and/or sewer main at his own expense. The cost of such a project shall be borne in the first instance by the individual property owner extending the water and/or sewer main. The cost of such a project shall then be divided equally among the buildable lots which front on such extension and which at the time of the extension do not have water and/or sewer service. Those individual property owners of buildable lots which front on such extension shall reimburse the individual property owner financing the extension at the time of tie-in of each such lot to the extension. Contribution shall be on a pro rata basis, e.g., if four lots front on the extension, each shall ultimately be responsible for payment of one-fourth of the cost of such extension. The assessment and transfer of funds shall be through the town water department. New service connections shall also be assessed the current tie-in fee.

(b)

At the time of the installation of any extension of water and/or sewer mains as provided in this section, the town water department shall cause to be recorded in the land evidence records of the town notice of the installation of such water and/or sewer main. Included in this notice shall be a listing (by tax assessor's plat and lot and the name and address of each owner) of those buildable lots fronting on such extension for the purpose of notifying those individual lot owners and their successors in interest of such extension and their responsibilities under the terms of this article.

DIVISION 3. - WATER LINE REPLACEMENT#

Sec. 74-201. - Funding.#

(a)

Water lines replaced through the department's capital improvement program shall be funded by the department through the capital improvement budget. Lots currently serviced will be responsible for replacing their individual service line to their respective lot from the main. Lots not currently serviced with frontage on the main shall be assessed an amount equal to the total of the project divided by the total number of lots with service and the unimproved buildable lots. Such assessment on the lots not currently serviced shall be payable at the time of tie-in to the main. New service connections will also be assessed the current tie-in fee.

(b)

At the time of the replacement of water and/or sewer mains as provided in this section, the town water department shall cause to be recorded in the land evidence records of the town notice of the replacement of such water and/or sewer main. Included in this notice shall be a listing (by tax assessor's plat and lot and the name and address of each owner) of those buildable lots fronting on such replacement for the purpose of notifying those individual lot owners and their successors in interest of such replacement and their responsibilities under the terms of this article.
