Sec. 74-1. - Location of utilities and recording of easements.#
(a)
All of the components of private water systems and of private sewage disposal systems, serving residential and commercial structures, shall be located within the property boundary upon which the building or dwelling is located, except as provided in subsection (b) of this section. The only exception to this requirement shall be where a valid, recorded easement exists sufficient to allow for the construction, repair and maintenance of all components of such system not located within the property boundaries where the building or dwelling is located. All such easements shall specifically identify the easement area and shall be recorded in the town's land evidence records, and a certified copy of such easement shall be filed with the town's building department. All amendments to any such utility easement shall be similarly recorded in the land evidence records and filed with the building department. Easements recorded in compliance with this section shall remain in effect so long as the property is served by a water and/or sewage disposal system having components situated within such an easement.
(b)
This section shall not be construed to impair or eliminate the requirements of all federal, state and local laws and regulations applicable to water and/or sewage disposal systems.
