The text

The council shall not authorize the issuance of any license under the provisions of this chapter in any of the following cases:

(a)

If the proposed business or activity to be operated is in violation of any state or city law or regulation;

(b)

Any person or persons having any interest whatsoever or at all in the ownership of a card club or casino licensed under this chapter, whether legal or equitable, or of whatsoever kind or character, whether same be as pointholder or owner, or a trustor or trustee, shall not manage, operate or have an ownership interest exceeding ten percent in any card club or casino located within a radius of fifty miles of the city limits.

The limitation in ownership interests described above includes and is applicable to any combination of persons whose cumulative ownership interest exceeds ten percent in a card club or casino doing business within a radius of fifty miles of the city limits.

The city council may waive these restrictions by resolution upon the finding that said waiver will neither harm the health, safety, and welfare of the public nor adversely impact the revenue of the city;

(c)

If the game for which a license is applied for is unlawful;

(d)

If a license is not available.
